Il diritto di recesso è la facoltà dell'acquirente/consumatore di venir meno agli obblighi del contratto stipulato.

Come esercitare questo diritto: · Nell'ipotesi di fornitura di beni, il consumatore può recedere entro il termine di quattordicii giorni lavorativi successivi alla consegna della merce, a condizione che tutti gli obblighi informativi siano stati adempiuti da parte del venditore prima della conclusione del contratto.

Nell'ipotesi in cui in venditore abbia omesso di assolvere ai propri obblighi informativi prima della conclusione del contratto, il recesso può essere esercitato dall'acquirente entro i 3 mesi successivi alla conclusione del contratto; se entro 3 mesi dalla conclusione del contratto il venditore provvede a far pervenire al consumatore le suddette informazioni il termine regredirà di nuovo a 14 giorni a decorrere dal ricevimento delle stesse;

Quali sono i limiti e le modalità di esercizio del diritto di recesso?

b) fornitura di beni confezionati su misura o chiaramente personalizzati o che, per loro natura, non possono essere rispediti o rischiano di deteriorarsi o alterarsi rapidamente;

c) fornitura di prodotti audiovisivi o di software informatici sigillati, aperti dal consumatore;

d) fornitura di giornali, periodici e riviste.

Il consumatore che intende recedere deve inviare, entro i termini sopra indicati, quattordici giorni dal ricevimento della merce,lettera raccomandata con avviso di ricevimento presso la sede del venditore.

Entro gli stessi termini, è ammessa la comunicazione del recesso anche a mezzo telegramma, telex, fax e anche email, salvo successiva conferma mediante lettera raccomandata con avviso di ricevimento entro le successive 48 ore.

La merce dovrà poi essere restituita a cura e spese del Cliente entro 10 giorni dalla data della raccomandata. Si provvederà alla restituzione dell'intero importo pagato (escluso le spese di spedizione) dopo aver accertato l’integrità della merce.
