Gli acquisti effettuati sul F.LLI PERTOSO Massimo e Antonella SNC sono regolati dalla legge italiana sulle vendite per corrispondenza. Nel caso in cui il Cliente abbia sbagliato l'ordine e abbia ricevuto un articolo che non desiderava, ha 10 (dieci) giorni di tempo dalla data di consegna per esercitare il diritto di recesso, ovvero la possibilità di restituire il prodotto.

Ai sensi degli artt. 64 e segg. DLT 206/2005, il Cliente consumatore, cioè persona fisica che agisce per scopi estranei all'attività imprenditoriale, commerciale, artigianale o professionale eventualmente svolta, ha diritto a recedere dal contratto di acquisto per qualsiasi motivo e di conseguenza ha diritto di restituire il bene acquistato e di ottenere il rimborso della spesa sostenuta, nel rispetto delle modalità di seguito indicate.

Il diritto di recesso è sottoposto alle seguenti condizioni:

a) il diritto si applica al prodotto nella sua interezza e non su parti o componenti di esso;

b) nelle ipotesi di operazioni a premio o vendite promozionali abbinate, in cui l'acquisto di un bene è associato ad un altro bene che viene venduto ad un prezzo irrisorio (o regalato), il diritto di recesso sarà legittimamente esercitato con la restituzione di entrambi i beni oggetto dell'acquisto (stante il vincolo dell'accessorietà del bene in promozione rispetto al primo).

Per esercitare il diritto di recesso, il Cliente, senza necessità di fornire spiegazioni e senza alcuna penalità, deve inviare entro il termine di 10 (dieci) giorni lavorativi dal giorno del ricevimento del bene, una comunicazione nella quale viene indicata la volontà di recedere dal contratto. Tale comunicazione dovrà essere inviata all'attenzione della F.LLI PERTOSO Massimo e Antonella SNC a mezzo lettera Raccomandata A/R con avviso di ricevimento, indirizzata alla F.LLI PERTOSO Massimo e Antonella SNC, Via Europa 24, Cellino San Marco (BR) 72020. Contestualmente all'invio della comunicazione di recesso, il Cliente dovrà attivarsi per la restituzione del bene alla F.LLI PERTOSO Massimo e Antonella SNC, utilizzando un corriere di propria scelta, con allegata copia della raccomandata sopra indicata. Il bene dovrà essere restituito integro ed accuratamente imballato nella confezione originale, completo di ogni accessorio. A norma di legge, le spese di spedizione relative alla restituzione del bene sono a carico del Cliente. Nel caso di più beni relativi ad uno stesso ordine, in relazione ai quali il Cliente ha esercitato il diritto di recesso, gli stessi dovranno essere inviati alla F.LLI PERTOSO Massimo e Antonella SNC con un'unica spedizione.

La F.LLI PERTOSO Massimo e Antonella SNC non risponde in alcun modo per danneggiamenti o furto/smarrimento di beni restituiti con spedizioni non assicurate. La F.LLI PERTOSO Massimo e Antonella SNC provvederà al rimborso del prezzo del bene per il quale il Cliente ha esercitato il diritto di recesso a condizione che il bene sia integro e non usato.
