Zero Insertion Fees Terms & Conditions

What is it?

On Saturday 08 and Sunday 09 June 2013 (local UK time), eBay.co.uk registered Private Sellers (subject to the below mentioned seller restrictions) who list up to 100 listing(s) (with a starting price of £1 or more) in an eligible category using the Auction-style format on eBay.co.uk, will not pay an Insertion Fee per listing.

Feature fees will still apply. The number of listings eligible under this promotion is limited to a maximum of 100 listings for sellers without listing restrictions or less where seller restrictions apply.

Items listed using professional tools, such as (but not limited to), Turbo Lister and Selling Manager Pro, are excluded. Items will only be eligible for this promotion if they are listed with the Quick Sell or Advanced Sell (Sell Your Item) forms, the new Quick Listing Tool or the eBay iPhone, eBay iPad, eBay Android, eBay Blackberry and eBay Windows Phone applications.

To take part in this promotion, sellers must be registered as resident in the UK.

When is it?

Saturday 08 June 2013 from 00:00:01 until Sunday 09 June 2013 23:59:59 local UK time (promotional period).

What's Included?

• Only items listed on eBay.co.uk using the Auction-style or Auction-style with Buy It Now option formats in an eligible category with a starting price of £1 or more are included. Listings using the Auction-style with Buy It Now format will be charged the Listing Upgrade Fee for Buy It Now.
• Sellers without seller restrictions may only list up to 100 eligible listings, with a starting price of £1 or more in the Auction-style format during the promotion period. Sellers with restrictions may only list in accordance with their limits. Once a seller has reached the maximum limit of 100 listings, any further items listed during the promotion period will be charged standard Insertion Fees according to the eBay Insertion Fees Policy.
• Auction-style listings with a starting price of between £0.01 and £0.99 are excluded from the promotion. Please refer to "What's Excluded?" for more details.
• Only sellers whose accounts meet eBay's minimum seller performance standards are eligible. Please refer to "What's Excluded?" for more details.
• Only items listed with the Quick Sell or Advanced Sell (Sell Your Item) forms, the new Quick Listing Tool or the eBay iPhone, eBay iPad, eBay Android, eBay Blackberry and eBay Windows Phone applications.
• Any eligible item previously scheduled to go live during the promotional period will qualify for the promotion.
• During the promotional period, if sellers re-list an eligible item that had previously closed without a successful sale, the re-listed item will be considered to be a part of the promotion and form a part of the 100 listings limit.
• If the re-listed item sells and is eligible under the eBay re-list policy, eBay will not refund the Insertion Fee, as sellers would not have paid an Insertion Fee (the promotional Insertion Fee price of 0 pence) for re-listing the item.
• For items listed in two categories, only the Insertion Fee for the first category will be eligible for the promotion. Standard Insertion Fees will be charged for listing the same item in a second category, according to eBay fees.
• Only Private Sellers registered on eBay,co.uk as resident in the UK are eligible.

What's Excluded?

• Business Sellers are not eligible to participate in this promotion.
• PowerSellers are not eligible to participate in this promotion.
• Sellers whose accounts do not meet eBay's minimum seller performance standards are not eligible to participate in this promotion. Please sign in to My eBay and view your seller dashboard to verify whether your account is currently meeting the standards. If you have completed fewer than ten transactions as a seller, this information will not appear in My eBay but you will receive email notification if your account falls below the minimum performance standards. • If you've registered after 15th March 2011 or have not listed any items for a while you may have a listing allowance of 10 items per month or of £650 per month, whichever is reached first, which you can increase. Additional verification may be required. Please click here to find out more.
• Auction-style listings listed with a starting price of between £0.01 and £0.99 will be excluded from the promotion, and will instead count towards your 100 free new listings/month, in accordance with the eBay Fees policy. Please see "Further Information" below for more details.
• All items listed in the "Cars, Motorcycles & Vehicles" category. (However items listed in the "Vehicle Parts & Accessories" category are included.)
• Items listed in the "Property" category.
• Identical listings that do not comply with our Duplicate Listings policy.
• Fixed Price (Buy It Now) format listings.
• Any item listed during the promotional period but scheduled to start after the promotional period does NOT qualify for the promotion.
• Any items listed which do not comply with eBay's Listing Policies or Prohibited and Restricted Items Policies.
• Items which are listed with a Reserve Price are excluded from this promotion.
• Only the basic eBay Insertion Fee will be reduced to 0 pence (£0.00). All other eBay selling fees will still apply, including but not limited to Final Value Fees, optional Reserve Price Fees and all Listing Upgrade Fees such as "Gallery Plus" or "Subtitle"; See the full details about eBay fees.
• All items listed with professional tools, such as (but not limited to)"Turbo Lister" and "Selling Manager Pro" are excluded from this promotion.

Members listing using the Auction-with-Buy It Now format will still be charged the Listing Upgrade Fee for Buy It Now.

Further Information

If you list items during the promotion period with a starting price of between £0.01 and £0.99, these listings will be excluded from the promotion and will count towards your 100 new listings/month limit. Please see here for more details about the 100 new listings per month limits.

General Terms

eBay reserves the right to suspend, change or cancel the promotion at any time, in the event of circumstances arising which, in eBay's opinion, make it necessary for it to do so. eBay reserves the right to add additional terms and conditions for certain parts of this promotion.

eBay also reserves the right to exclude users on the basis that their seller accounts have fallen below the minimum required seller performance standards. Sellers should confirm eligibility by checking their account status on My eBay.

The decision of eBay regarding any aspect of this promotion is final and no correspondence will be entered into.

Nectar Millionaires prize draw – Terms and Conditions

Promotion Period

The Nectar Millionaires prize draw ("Promotion") will be open from 00:00:01, 8th June 2013 BST and will end on 23:59:59, 9th June 2013 BST ("Promotion Period").

Eligibility

The Promotion is open to all UK residents (excluding Northern Ireland) aged 18 years or over at the start of the Promotion Period who are registered on www.eBay.co.uk (the "Site") and have a Nectar card linked to their Site account and who meet eBay's seller performance minimum standards. Employees (and their families) of eBay Europe S.a.r.l. ("eBay"), Aimia Coalition Loyalty UK Limited ("Aimia"), any affiliates, subsidiary companies of eBay or Aimia, any representatives or agents of those companies and anyone else who may be directly involved with the Promotion in a professional capacity are not eligible to participate in the Promotion.

Procedure

In order to enter the Promotion, entrants must have:

1. Linked their Nectar card with their Site account on the Nectar page on the Site; and
2. Listed an item on the Site in an eligible category (see category exclusions below) during the Promotion Period. Once a user lists an item using a Site account linked to a Nectar card, the user will be entered into a random prize draw in order to win a Prize.

Each entry that takes place during the Promotion Period following the procedure laid out above will be considered to be an "Eligible Entry". Entrants can only enter once during the Promotion Period.

Please note that the item the entrant lists does not have to sell in order to be an Eligible Entry.

Opt-out/Opt-In

If you wish to opt-out of this Promotion and not be eligible to win any Prize, then please e-mail DL-eBay-NectarMillionairesMarch2013@ebay.com using the following as a subject line: "Nectar Millionaires promotion opt-out" and put your user ID in the body of the e-mail.

If you have opted out of eBay marketing, then you will NOT be able to enter the Promotion. If you still wish to participate, then please e-mail DL-eBay-NectarMillionairesMarch2013@ebay.com using the following as a subject line: "Nectar Millionaires promotion opt-in" and put your user ID in the body of the e-mail.

To win a prize

The winners will be the first 11 entries selected at random from all the Eligible Entries received by eBay during the Promotion Period.

Prizes

The prizes are Nectar points (each a "Prize"). There is no cash alternative and a Prize cannot be transferred. The following Prizes are available to win during the Promotion Period:

1. One person will win 1,000,000 Nectar points.
2. 10 x runners up will win 100,000 Nectar points

Please note that entrants who make Eligible Entries will be entered into a draw to win any of the above Prizes. Entrants can only enter the Promotion once. The first winner selected at random will win the top prize of 1,000,000 Nectar points, and the next 10 winners will win 100,000 Nectar points each.

Winner Notification

The prize draws will take place within 14 days of the end of the Promotion Period. Winners will be informed within 14 days of the prize draw at the e-mail address associated with their eBay.co.uk account. The Nectar points will be automatically credited to the linked Nectar card associated with the Site account within 28 days of the prize draw. A Prize will be awarded to the linked Nectar account only and is not transferrable. If for any reason the Nectar account cannot be credited (e.g. – if it is blocked or suspended), the entitlement to the Prize will lapse.

Winners of the Prizes may be contacted via e-mail or phone as per the contact details present in their Site account before the Prize is credited to their Nectar account.

Entrants are responsible for ensuring that the contact details present in their account are accurate and up to date, including, but not limited to, the county of their address.

eBay reserves the right to verify the eligibility of any of the entrants.

Winner details

The names of the winners and their counties will be available from 5th July 2013. To receive this information, send an e-mail to DL-eBay-NectarMillionairesMarch2013@ebay.com with the subject line: 'Winner details request'.

Exclusion From Participation

Business sellers and PowerSellers are not eligible to participate in this Promotion.

Any item listed during the Promotion Period but scheduled to start after the Promotion Period does NOT qualify for the Promotion.

Any items sold which don't comply with eBay's Listing Policies or Prohibited and Restricted Items Policies do not qualify for the Promotion.

All items sold in the following categories are not eligible for Nectar points on the Site and will not qualify for the Promotion:

1. Cars, Motorcycles and Vehicles (Parts and accessories are NOT excluded)
2. Holidays & Travel
3. Property
4. Gift Vouchers & Coupons
5. Baby Feeding: Formula

Sellers whose accounts do not meet eBay's minimum seller performance standards are not eligible to participate in this Promotion. Please sign in to My eBay and view your seller dashboard to verify whether your account is currently meeting the standards. If you have completed fewer than ten transactions as a seller, this information will not appear in My eBay but you will receive email notification if your account falls below the minimum performance standards. Any attempt to manipulate the Promotion is prohibited and will result in exclusion from participation.

If eBay has suspicions or knowledge that any entrant has been involved in any fraudulent or illegal activity, eBay reserves the right to disqualify that entrant and any related entrants. eBay may also disqualify any entrant that does not act in accordance with these Terms and Conditions, eBay's User Agreement, the Nectar programme terms and conditions, and/or any policies that eBay may communicate to you.

Entrants whose Nectar or eBay account is blocked, closed or restricted or becomes blocked, closed or restricted for any reason during the Promotion Period are or will be excluded from participating in the Promotion.

Data Use, Data Privacy Protection

The prize draw will be conducted by Aimia. In order to facilitate this, your eBay user id will be sent to Aimia. By participating in this Promotion, you agree to this.

By accepting the prize, the winner(s) of the Prizes irrevocably grant eBay permission to use his or her name, biographical data, picture and other collected information for advertising, promotional or publicity purposes.

Limitation of liability

eBay makes no representations or warranties of any kind regarding any product or service provided by any third party in connection with any Promotion.

eBay shall not be liable, in contract or tort (including negligence) or the breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by the entrant resulting directly or indirectly from entry to this Promotion. Nothing in these terms shall limit eBay's liability for death, personal injury or fraud.

eBay will not be responsible for any third party's performance or failure to perform any services related to any Promotion, or for any costs, damages, accident, delay, injury, loss, expense, or inconvenience that may arise in connection with the use of the Promotion, provided that nothing shall limit eBay's liability for death or personal injury caused by its negligence.

eBay does not accept, and is not responsible for, any lost or delayed entries. eBay reminds entrants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may affect entry to the Promotion.

Although eBay will use reasonable efforts to ensure that all information relating to the Promotion ("Promotion Material") is accurate, eBay is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect eBay's operation of the Promotion or the site, including without limitation the accuracy of any Promotion Material.

General

eBay reserves the right to suspend, change or cancel this Promotion at any time, in the event of circumstances arising which in eBay's opinion make it necessary for it to do so. eBay reserves the right to add additional terms and conditions for certain parts of this Promotion. This includes the ability to substitute a prize, which is, in eBay's reasonable opinion, of equivalent value, change the specification of the prize if circumstances require it or change the entry procedures to an email format.

The decision of the adjudicator regarding any aspect of this Promotion is final and no correspondence will be entered into.

eBay may use third parties to facilitate one or more elements of the Promotion. These third party service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit the use of the information we provide them for any other purpose except to facilitate the specific outsourced eBay related operation. These Terms and Conditions are governed by the law of England and Wales. Each party irrevocably agrees to the exclusive jurisdiction of the English courts over any claim or matter arising under these terms and conditions.
