DIRITTO DI RECESSO

I riferimenti normativi in materia sono il D.Lgs. 50/1992 e ilD.Lgs. 185/1999.

Il diritto di recesso può essere esercitato dal consumatore finale, ovvero da "persona fisica che (...) agisce per scopi che possono considerarsi estranei alla propria attività professionale" (secondo art.2, comma 1, lett. a del D.Lgs. 50/1992).

Il consumatore ha diritto di recedere da qualunque contratto a distanza, senza alcuna penalità e senza specificarne il motivo, entro il termine di dieci giorni lavorativi decorrente, per i beni, dal giorno del loro ricevimento da parte del consumatore ove siano stati soddisfatti gli obblighi di cui all'art.4 del D.Lgs. 185 del 22 maggio 1999, o dal giorno in cui questi ultimi siano stati soddisfatti, qualora ciò avvenga dopo la conclusione del contratto, purché non oltre il termine di tre mesi dalla conclusione stessa del contratto.

Il diritto di recesso si esercita provvedendo all'invio di una comunicazione scritta, mediante lettera raccomandata con avviso di ricevimento, all'indirizzo:

oppure mediante telegramma, telex e fac-simile, a condizione che sia confermata mediante lettera raccomandata con avviso di ricevimento entro le 48 ore successive.

In base al D. Lgs. 185/1999 il diritto di recesso è escluso per i contratti:

- di fornitura di servizi la cui esecuzione sia iniziata, con il Tuo accordo, prima della scadenza del termine di 10 gg.;

- di fornitura di beni e servizi il cui prezzo è legato a fluttuazioni dei tassi del mercato finanziario che il fornitore non è in grado di controllare;

- di fornitura di beni confezionati su misura o chiaramente personalizzati o che, per loro natura non possono essere rispediti o rischiano di deteriorarsi o alterarsi rapidamente;

Qualora sia avvenuta la consegna del bene il consumatore è tenuto a restituirlo o a metterlo a disposizione del fornitore o della persona da questi designata, secondo le modalità e i tempi previsti dal contratto. Il termine per la restituzione del bene non può comunque essere inferiore a 10 giorni lavorativi decorrenti dalla data di ricevimento del bene.

Il consumatore può adempiere all'obbligo di restituzione anche ponendo a disposizione del fornitore (o di chi per lui) il bene secondo quanto previsto nel contratto.

Con la comunicazione del recesso, secondo le formalità previste nel decreto, il consumatore è sciolto dal vincolo assunto con il venditore.

Se la consegna del bene è avvenuta, il consumatore deve restituire la merce integra, non usata e nella sua confezione originale entro i termini previsti (fa fede l'accettazione dell'ufficio postale o dello spedizioniere). Le spese sono a carico del consumatore.

Il venditore entro 30 giorni dal ricevimento della comunicazione di recesso deve rimborsare al consumatore le somme già eventualmente corrisposte.
