1. Diritto di recesso di Prodotti materiali

L’Utente che riveste la qualità di consumatore e che per qualsiasi ragione non si ritenesse soddisfatto dell’acquisto eettuato di Prodotti materiali ha diritto di recedere dal contratto stipulato, senza alcuna penalità e senza specicarne il motivo entro il termine di 14 giorni a decorrere dalla data di consegna del Prodotto.

Resta inteso che il diritto di recesso di cui al paragrafo precedente è escluso nei seguenti casi:

fornitura di Prodotti sigillati che non si prestano ad essere restituiti per motivi igienici o connessi alla protezione della salute e sono stati aperti dopo la consegna;

Al ne di recedere dal contratto, l’Utente dovrà contattare il Titolare all’indirizzo e-mail ebay@pianetacapelli.it o chiamare il Servizio Clienti al numero 3737148300. L’Utente sarà informato delle modalità concernenti la restituzione del Prodotto. L’invio della comunicazione potrà validamente essere sostituito dalla restituzione del Prodotto acquistato, purché nei medesimi termini. Farà fede fra le parti la data di consegna all’ufficio postale o allo spedizioniere.

In caso di recesso, il Titolare rimborserà i pagamenti ricevuti dall’Utente nonché le spese di consegna senza indebito ritardo e, comunque, entro e non oltre 30 giorni dal giorno in cui l’Utente ha comunicato al Titolare di voler recedere dal contratto.

Il Titolare rimborserà l’Utente nelle stesse modalità di pagamento utilizzate dall’Utente per l’acquisto online.

L’Utente deve restituire i Prodotti a proprie spese, salvo che il Fornitore non accetti di accollarsele, senza indebito ritardo e in ogni caso entro il termine di 14 giorni dalla data in cui ha comunicato al Titolare la sua decisione di recedere.

L’Utente è responsabile dell’integrità del Prodotto n tanto che lo stesso bene si trova in suo possesso e dovrà adottare tutte le misure adeguate per preservare il Prodotto e fare tutto il possibile anché il Prodotto sia restituito nelle migliori condizioni possibili, compreso l’imballo originale non danneggiato, i manuali di istruzioni, gli accessori, eventuali articoli separati e qualsiasi altro componente. Il Prodotto non deve essere stato oggetto di manipolazione diversa da quella necessaria per stabilire la natura, le caratteristiche e il funzionamento del Prodotto.

Il Titolare non prenderà in considerazione richieste di restituzione nel caso in cui il Prodotto restituito risulti malfunzionante a causa di utilizzo improprio, negligenza, danni o alterazioni siche, estetiche o superficiali, manomissioni o manutenzione impropria o usura e logorio.
