TERMINI, MODALITA' E CONDIZIONI PER L'ESERCIZIO DEL DIRITTO DI RECESSO

OBBLIGHI ED INCOMBENTI DEL CONSUMATORE:

Esercitare il diritto di recesso e, pertanto, comunicarlo per iscritto entro e non oltre 14 giorni dalla ricezione dei beni acquistati da Pi Logico srl; a tal fine fa fede la data di spedizione della comunicazione;

Restituire i suddetti beni entro e non oltre ulteriori 14 giorni dalla data in cui ha comunicato alla medesima società la sua decisione di recedere dal contratto, evidenziando che detta restituzione è condizione essenziale ed imprescindibile per il rimborso; a tal fine conta la data risultante dalla ricevuta di spedizione e la prova della tempestività è a suo esclusivo carico;

Sostenere i costi di restituzione della merce acquistata, a suo esclusivo carico e pertanto non rimborsabili;

Sostenere i costi di diminuzione del valore dei beni per l’eventuale utilizzo degli stessi eccedente quello strettamente necessario per stabilire la natura, le caratteristiche e il funzionamento degli stessi una volta ricevuti; ogni utilizzo eccedente il minimo consentito per la prova del bene acquistato è dunque a carico del consumatore e sarà decurtato dal prezzo inizialmente corrisposto da rimborsare.

Consegnare i beni acquistati dal Consumatore senza ritardo ingiustificato e al più tardi entro trenta giorni dalla data di conclusione del contratto (perfezionamento dell’acquisto on line);

Garantire al Consumatore spese per il pagamento non eccedenti quelle sostenute dal Professionista stesso, qualsiasi sia stato lo strumento di pagamento utilizzato; non potrà pertanto imporre al consumatore costi aggiuntivi ingiustificati ove il medesimo scelga un diverso strumento di pagamento, come ad esempio carta di credito o Bancomat in luogo di contanti;

Rimborsare, entro e non oltre gg. 14 dalla conoscenza dell'esercizio del diritto di recesso, previa restituzione della merce resa, tutti i pagamenti ricevuti dal consumatore esercente, comprensivi delle spese di consegna eventualmente applicati, utilizzando lo stesso mezzo di pagamento usato dal consumatore per la transazione iniziale, salvo che quest'ultimo non abbia espressamente richiesto altrimenti nella missiva avente ad oggetto il diritto di recesso.
